A 49-year-old father was killed in an apparent road rage incident in California while his wife and children were at home, officials and family members said.

The victim, identified by relatives as Jason Elola, was leaving a birthday party for one of his sons when the fatal altercation took place, according to the Alamesta County Sheriff’s Office.

Family members said Elola, his wife Gabrielle, and their two young daughters were on their way back from an 18th birthday party for one of his sons when they decided to stop for ice cream at Castro Valley in Castro Valley.

“On November 8, our family was devastated when our brother, brother, father, and friend Jason Elola passed away,” a family member wrote.

Elola’s son, Angel Elola, told KTVU that his father was not the kind of man to get together and try to protect his family after a minor collision.

The angel said that the car allegedly hit the back of his father’s car as it exited the highway.

“My father, the protector, he is the protector, he wanted to make sure that his wife, five-month-old baby, and five-year-old daughter were okay,” said the angel. “He came out and wanted to see what the problem was.”

The angel said that his father was trying to escalate the situation when confronting and arguing turned into violence.

He said: “When he came out, it happened very quickly, it is possible that his father suffered a head injury, although the coroner will determine the official cause of death.

Gabrielle Elola, Jason’s wife, said the suspect’s black SUV was smeared in its lane after exiting the highway.

“When my husband went to surround the enemy, he kept hitting the back of our car,” she said. “We are scared. My husband came out to protect us.”

Gabrielle said she didn’t see the actual fight but saw her husband lying on the ground from time to time.

“This person did not take my husband,” she said. “He could have been fired. He could have done something else – but this … you can’t just take someone from their family. We’re not going to bring him back.”

Authorities initially arrested 37-year-old Martin W. Davis. Suspected of murder after he reportedly left the scene, he called the California Highway Patrol Hotline to report his involvement, then returned to cooperate with investigators.

However, the Alamera County Sheriff’s office confirmed that on November 13, Davis was released from Santa Rita Jail pending further investigation.

Investigators are asking anyone with Dashcam or cell phone video from the area around Wilbeam and Norbrbodge Avenues, near the Castro Valley Bart station, to come forward.

Elola, a pumpkin patch and Christmas tree, was described by family members as the heart of their large, intimate home.

His son wrote in a Facebook post:

“For those of you who don’t know, father Jason Elola was tragically killed this past weekend.

My father taught us all how to love, be compassionate, and not give up. His legacy will live on forever. “
